1. Acceptance
By using AVAULTX™ — as a guest, owner, host, provider, architect, or partner — you agree to these Terms. If you don't agree, don't use the Platform.
2. What AVAULTX™ Is
AVAULTX™ is a technology platform that connects property owners, certified hosts, service providers, architects, and guests. We facilitate property documentation, vaulting, certification, bookings, concierge services, and sponsorship — but we are not a party to any rental, service, or sale contract between users. All contracts are directly between the parties.
3. Accounts & Verification
Provide accurate information. Keep your login secure. You're responsible for all activity under your account. We may verify identity and suspend accounts with false information.
4. Property Listings & Owner Responsibility
Owners are responsible for the accuracy of everything in their Property Vault — drawings, compliance certificates, maintenance records, specifications. The Golden Glove certification confirms documentation meets our standard; it is not a building inspection or legal warranty.
Architects published in the Vault must hold valid SACAP registration. Builders must be NHBRC-registered for projects over R650,000. Engineers must be ECSA-registered. We may verify and display registration status.
Architects and developers may submit concept designs to the public Concept Gallery. Each submission requires a one-time R99 fee. Submitters set their own design-package price and choose whether to display it publicly or keep it private (shown only on inquiry). The Platform reviews every concept before publication. Concept designs are architectural ideas, not construction plans — site adaptation is quoted separately by an appointed architect.
Owners may upload personal property photos to their private Owner Photo Journal. These photos are stored privately and are visible only to the owner and administrators. They document the property's lifecycle journey and are not displayed publicly.
5. Fees
Rental: Short-term (Airbnb): 3.5% platform fee on nightly rate plus 15% hosting fee (host receives 10%, Golden Key Stays receives 5%). Long-term rental: 7.5% of rent collected, split 5% to the managing agent and 2.5% to AVAULTX™. Cleaning R950/stay (R450 for short stays of 3 nights or fewer), stock R1,200/stay. Owner subscription (Live it tier): R599/month — no free tier, no trial, no waiver.
Sale: No separate platform sale fee — the sale-ready Vault package (drawings, compliance certificates, maintenance history, Golden Glove certification), AI valuation modelling, buyer matching, and marketing are all included in the owner's monthly subscription. If the owner engages an agent host to facilitate the sale, a 5% sale commission applies, split 2.5% to the agent and 2.5% to Golden Key Stays. Geographic partners may also earn a sale commission per their partnership agreement.
Providers: R599/month from the outset — no free tier, no trial, no free-lead allowance. 10% commission on arrival packages (provider keeps 90%, owner earns 5%). Tips pass through at 100%.
Agent Hosts: R1200/month subscription (rent-it-cycle access). 15% hosting fee on short-term accommodation revenue (host receives 10%, Golden Key Stays receives 5%). 7.5% of rent collected on long-term rentals, split 5% to the managing agent and 2.5% to AVAULTX™. 5% sale commission split 2.5% to agent / 2.5% to Golden Key Stays. Must hold a valid PPRA Fidelity Fund Certificate.
Architect Concepts: A one-time R99 submission fee applies per concept submitted to the Concept Gallery. Concepts are saved as drafts until payment is received. Architects and developers set their own design-package price and choose whether to display it publicly or keep it private.
6. Property Sale Route
Owners choose: sell privately with their own attorney, or engage their agent host to facilitate. No exclusive mandate is required. The Platform provides a sale-ready Vault package (drawings, compliance, maintenance history, Golden Glove certification), AI valuation modelling, buyer matching, and marketing — but does not act as the seller's agent.
All offers are recorded in the Platform. The owner accepts or rejects at their sole discretion. The Alienation of Land Act cooling-off period applies only to properties under R250,000. Upon transfer, the full Vault — including sponsorships — transfers to the new owner. The owner may withdraw at any time with no penalty.
7. Intellectual Property
The AVAULTX™ brand, Golden Glove Standard, logo, and Vault system are the exclusive property of AVAULTX™ (Pty) Ltd. No reproduction without written consent.
8. Privacy & POPIA
Governed by our Privacy Policy and the Protection of Personal Information Act (POPIA). Vault data is encrypted at rest and in transit. No system is impenetrable.
9. Conduct
Don't use the Platform unlawfully, submit false information, access others' accounts, interfere with the Platform, or circumvent Platform fees by transacting outside it after being connected.
10. Property Management Standards
Property Managers must keep listings accurate, maintain 12 months of seasonal rates, sync calendars to prevent double-bookings, respond to enquiries within 24 hours, verify guest identity at check-in, and resolve issues professionally. Managers are responsible for resolving double-bookings at their own cost.
11. Termination
We may suspend or terminate accounts for breach, fraud, or harmful conduct. Vault data may be retained for compliance purposes as required by law.
12. Governing Law
South African law governs these Terms. Disputes are subject to South African courts — negotiation first, then mediation, then litigation.
13. Amendments
We may amend these Terms at any time. Continued use after notification constitutes acceptance.
14. Contact
All communication with the AVAULTX™ team is through the in-app messaging system. No external emails or phone numbers are published. Every message is encrypted, access-controlled, and permanently logged.
